This BBX Privacy Policy explains how we manage your privacy and the information you provide to us. This policy applies across all companies within the group, including the BBX Property Investment Fund Limited.
Resolving Concerns - BBX is totally committed to the security and protection
of your personal information and our policies, systems and procedures are
developed and maintained with this in mind. Despite our best endeavours
however, errors will sometimes occur due to oversight or perhaps a mistake
by one of our staff. Should this occur please contact us immediately.
We will respond to your concern or complaint within 48 hours of receiving
it, and attempt to resolve it within 10 working days. Where we have made
a mistake we will apologise, and take all reasonable steps to ensure that
it doesn't happen again.

Why it is Important
In order that we can do business certain information is required so as to
enable the establishment of sound and proper administrative practices and
processes. BBX has always treated information supplied by customers in a
confidential manner. Protecting your privacy and maintaining confidentiality
of personal information is fundamental to developing trust in your business
relationship with BBX. As an organisation providing financial services to
all BBX members, we treat very seriously the protection of your information
however collected and stored.
Collecting your Personal Information
We will only collect information that we require in order to facilitate
our business dealings. Most information will be collected at time of establishing
your BBX relationship, although we may subsequently collect information
during telephone calls with you, when you visit our web site, if you send
us a letter, or when you visit a BBX office in person. We will usually collect
this information from you personally, and will tell you if information is
collected from other sources at any time. Whilst the information will in
most cases relate to maintaining your account or investment, more sensitive
information may be collected from time to time but only if appropriate to
do so in terms of products or services we are able to offer. As far as practicable
conversations we have with you will be kept private and we will do what
we can to maintain the confidentiality of those conversations.
Using your Information
Your personal information will be used primarily for the purpose of performing
services to you in respect to the conduct of the company’s business.
Most information you provide is for internal accounting or administration
purposes. This information will usually be standard business things such
as your business telephone number, fax number, web or email address so as
to enable contact to be made with you.
It will not include more personal information unless circumstances dictate,
and if this is necessary we will contact you beforehand. We may be bound
by law to release personal information (for example, disclosure to law enforcement
offices or the courts). From time to time we may use the information you
have supplied for the purpose of offering products and services that may
benefit you. However, you can decide not to receive such information by
giving us notice to this effect.
Who will use it?
Your personal information will only be recorded within the BBX group of
companies, and we will not exchange with or sell your information to other
groups or persons unless your prior consent is given. We may provide information
to a third party (such as a mailing house) for the purpose of sending things
to you. However, information supplied cannot be used other than for the
purpose for which it is given. Where necessary contractual agreements will
be put in place to safeguard the information provided in these circumstances.
In other circumstances it may be necessary to give your information to a third party, and such instances will include (but may not be limited to):
- Other organisations we may form alliances with for the purpose of promoting our respective products and services
- Our external advisers (accountants, solicitors, auditors etc.) whom we engage to carry out functions and activities on our behalf;
- Your own agents, such as your accountant or legal/financial adviser.
Security of Information
Systems and processes are in place to safeguard your information from unauthorised
access or disclosure to others. Only employees of the BBX group of companies,
and those who perform services on our behalf, will have access to your personal
information. Information will be stored or retained by us in accordance
with any regulatory and legal obligations we may have. The information we
have is accurate insofar as has been provided to us. If you find information
to be inaccurate you should contact us immediately and we will, upon becoming
aware, take corrective action to bring it up to date. You can help us protect
your privacy by contacting us immediately your contact details change eg.
address, telephone number.
Access to Information
You can access most of the information we maintain about you and request
corrections if necessary. There may however, be some exceptions, for example:
- We may not allow you access to information relating to existing or proposed legal action;
- If it threatens the privacy of other members/individuals;
- We are prevented by law from disclosing certain information.

This service will normally be provided free unless your request involves substantial research and/or preparation time, in which case a fee may apply. Before we act on such requests we will let you know the cost.
